1. Acceptance of Terms

By accessing our website, reserving accommodation, contracting venue hire, or visiting HK Gardens in Nanyuki, Kenya, you agree to comply with and be bound by these Terms and Conditions. If you are booking on behalf of an event party, organization, or family group, you warrant that you have the authority to accept these terms on behalf of all members.

2. Accommodation & Cottage Stays

• Check-In & Check-Out: Check-in is available from 2:00 PM on the day of arrival. Check-out is by 10:00 AM on the day of departure. Early check-in or late check-out is subject to availability and prior written confirmation.
• Occupancy: Each of our four 2-bedroom villas (Chui, Simba, Nyati, Kifaru) has a maximum registered guest capacity. Subletting or exceeding registered occupancy without management authorization is prohibited.
• Self-Catering & Furnishings: Cottages are provided fully furnished with kitchen appliances, tableware, and linen. Guests are expected to treat the cottages with care and report any accidental damage promptly.

3. Event Grounds & Venue Hire

• Venue Coordination: All wedding marquees, conference setups, sound systems, and external caterers must be coordinated in advance with the HK Gardens event manager.
• Power & Utilities: HK Gardens provides standard power access and standby generator support for contracted events. High-drain equipment (specialized lighting, staging rigs) must be declared prior to installation.
• Clean-up & Clearing: Event organizers and external decorators are responsible for removing all temporary structures, decor, and waste within the designated strike-down window.

4. Payment & Cancellation Policy

Bookings are secured upon receipt of the agreed deposit. Detailed payment schedules and cancellation conditions are specified in your written booking confirmation or contract:

• Cancellations received well in advance of arrival are eligible for date rescheduling or partial refunds as defined in your booking quote.
• Late cancellations or no-shows are subject to full forfeiture of the reservation deposit.
• Full settlement of all remaining balances is required prior to check-in or event commencement.

5. Estate Guidelines & Garden Etiquette

HK Gardens is dedicated to tranquility, natural beauty, and environmental stewardship:

• Quiet Hours: Outdoor amplified music must conclude or be lowered to ambient acoustic levels by 10:00 PM to respect neighboring properties and in-house cottage guests.
• Flora & Grounds: Guests are requested to respect our botanical flora, flowering shrubs, and pathways. Cutting or damaging trees and garden plantings is strictly prohibited.
• Smoking & Fire Safety: Smoking is permitted only in designated outdoor zones. Open fires are restricted strictly to designated stone fire pits with staff attendance.

6. Liability & Personal Property

While HK Gardens maintains 24-hour perimeter security and gated entry, guests are responsible for securing their personal belongings, valuables, and parked vehicles. HK Gardens accepts no liability for loss, theft, or damage to personal property unless caused directly by proven gross negligence of our staff.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising hereunder shall be subject to the jurisdiction of the competent courts of Kenya.
